Syncopate Terms of Use
By using or accessing Syncopate you agree to these terms.
Privacy
- We will not sell or give your private information to third-parties.
- We will do everything in our power to protect the data that you have entrusted us with.
Uploaded and Posted Content
- Your data is yours. Period.
- If you delete your account, we may hang on to your content (because of backups, etc.) but it will no longer be available to the public.
- Bands may choose to make their Band group inactive, but keep its media available to the public.
- We may use your uploaded content on the site itself for promotional use, but we will not use it in any other media without your permission.
User Accounts
- You will not post false information or create an account posing as someone else.
- You will not create an account if you are under 13 years of age.
- You will not use Syncopate if you are located in a country embargoed by the U.S., or are on the U.S. Treasury Department’s list of Specially Designated Nationals.
Group Accounts (Bands, Labels, Venues, etc.)
- You will not post false information or create a group posing as an entity that you are not authorized to act for.
- We encourage, but do not require, verification of your group. Those methods are explained elsewhere on Syncopate.
- We reserve the right to limit access to unverified accounts.
Behavior
- You will not bully, intimidate or harass other users.
- You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
- You will not use Syncopate to do anything unlawful, misleading, malicious, or discriminatory.
- You will not post someone else’s intellectual property (music, photos, videos, text, etc.) without their permission.
- We will comply with DMCA takedown notices according to U.S. law. See Online Copyright Infringement Liability Limitation Act
Access
- Any fees associated with accessing the site (ISP connection, mobile data connection, SMS fees, etc.) are the responsibility of the user.
- The site may experience scheduled and non-scheduled downtime occasionally. We give no guarantee for uptime reliability or take any responsibility for loss of revenue because of downtime.
Advertisements
- We will allow third-party advertisers on Syncopate but will not provide them with your user data. However, many browsers allow third-parties to collect your information without our consent. You can disable this in your browser. See this article for more information.
- We will allow advertisers to send messages to our users at times. These messages will be marked as a paid advertisement.
Disputes
- The laws of the State of Washington will govern this Terms of Service. Any dispute must be settled through arbitration by an arbitration panel approved by both parties.
- If anyone brings a claim against you for your actions on Syncopate, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
- Syncopate is use at your own risk. While we will do our best to provide a top quality service to you, Syncopate is provided “as is”. We do not guarantee, warranty or otherwise claim that Syncopate is suited for any particular purpose.
- If applicable law does not allow Syncopate full indemnity, liability will be limited to the fullest extent allowed by law.
Termination of Accounts
- We reserve the right to suspend temporarily, indefinitely, or permanently any account at our discretion.
- Violations of this Terms of Service will result in account termination.
Amendments
- If we need to change this Terms of Service, you will receive a notice in the form of a Syncopate message at least 7 days in advance. If you choose to not agree to the new Terms of Service, please terminate your account at that time. Continuation to use Syncopate will serve as an agreement to the amended Terms of Service.
- If more than 1000 users comment on a proposed change, we will suspend the amendment and hold an online community forum to discuss possible alternatives and reach a resolution together as a community.
